1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.290/2020, registered at Police Station - Chuikhadan, DistrictRajnandgaon (C.G.) for the offence punishable under Sections 450, 302 of the Indian Penal Code.

3. Applicant has allegedly committed murder of his Badi Mummy Kunj Bai and elder sister Chandrika Janghel in the intervening night of 16/1711-2020. The spanner used for hitting the deceased persons has been recovered from the applicant pursuant to his memorandum statement. The villagers had seen the applicant moving with the spanner in an intoxicated position in the evening of 16-11-2020. He was also shouting about killing somebody.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the seriousness of the crime and the material available in the case diary, I am not inclined to release the applicant at this stage.

6. Accordingly, the bail application is rejected reserving liberty to the applicant to revive the prayer after examination of witnesses to the memorandum statement and seizure.
