1. State Of Chhattisgarh Through The Secretary, Department Of Health And Family Welfare, Mantralaya, Mahanadi Bhawan, Naya Raipur District Raipur Chahttisgarh

2. Director, Department Of Health And Family Welfare, Directoate New Raipur, District Raipur Chhattisgarh

3. Commissioner, Department Of Health And Family Welfare, Chhattisgarh Raipur, District Raipur Chhattisgarh ---- Respondents ------------------------------------------------------------------------------------------------------- For Petitioner : Mr. Rajesh Ranjan Sinha, Advocate For State / : Mr. Gary Mukhopadhyay, Dy. Govt. Advocate Respondent No.1 on advance copy.

------------------------------------------------------------------------------------------------------- Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 10/08/2016 Heard.

1.

Challenge to the impugned order dated 24.07.2016 is based on the ground that earlier the petitioner's claim for regular promotion on the post of specialist, was rejected on the ground that the petitioner's service record is not upto the mark, but, now the petitioner has been transferred to the higher post i.e. on the post of specialist. 2.

It is not a case where the petitioner has been sent to the lower post, but he has been sent to the higher post. In fact, the petitioner's claim is for the post of specialist, therefore, the order does not visit any kind of penalty, but only a reward by giving him assignment in the higher post, therefore, there is no other ground to warrant interference by this writ Court.

3.

The petition is accordingly, dismissed.
