Since both the bail applications are arising out of crime No.752/2020 they are being considered and decided by this common order.

The applicants have preferred these bail applications under Section 439 of CrPC, as they are arrested in connection with Crime No.752/2020, registered at Police Station Kawardha, District Kabeerdham (CG), for the offence punishable under Sections 457, 380, 34 of the Indian Penal Code. 3.
Applicants have committed theft of Rs.3,39,057/- from the office of e-Commerce Express Delivery Center in which the complainant Neel Kamal Chandravanshi was posted as Supervisor.

Learned counsel appearing for the State, per contra, would oppose the bail applications, however, he would submit that the concerned SHO has not reported any previous criminal antecedents of the applicants.

Considering the entire facts situation of the case; as also the fact that the applicants are in jail since 9-3-2021 (Nandkishore Thakre @ Nandi @ Nandu) and 11-6-2021 (Chataru Bhavre); the charge sheet has already been filed; and the offences are triable by the JMFC, I am of the opinion that present is a fit case to release the applicants on regular bail.

Accordingly, both the bail applications are allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
