1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.139/2020 registered in Police Station Pali, Police Assistance Center, Chaitma District Korba for offence under Sections 376 and 506 of the IPC.

2. The prosecutrix is a married lady, having one son aged about 3 years. Her husband works at poultry farm in different village. At about 11 pm on 6.6.2020, the applicant came to her house and committed forcible sexual intercourse. On 14.6.2020, she along with her husband and children were sleeping in their house and at about 11 pm, the applicant reached her house and knocked the door and finding that the door has

been opened by her husband, assaulted him. FIR has been lodged on the next day i.e. 15.6.2020.

3. Considering the delay in lodging the FIR and for the fact that the prosecutrix being a married lady kept quiet for 8 days and that the applicant is in jail since 16.6.2020, this Court is inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
