Mr. Kunal Das, P.L.

Hon'ble Shri Justice P. Sam Koshy Order On Board 29.06.2021

1. The limited grievance of the petitioner in the present writ petition is the inaction on the part of the respondents in not releasing the annual increment payable to the petitioner immediately on his clearing the Hindi Typing Examination.

2. The petitioner herein was appointed on compassionate basis on the post of Assistant Grade-III at Govt. High School Jarve, Block Kartala,

District Korba. The petitioner was not qualified in Hindi typing at that point of time and he was granted two years time for clearing Hindi Typing Examination and it was also mentioned that he would be entitled for annual increment only on his clearing Hindi Typing Examination. According to the petitioner, he had cleared Hindi Typing examination in the year 2012 and had produced the certificate immediately to the respondents but till date the annual increment payable to the petitioner has not been provided to him.

3. Given the limited relief that the petitioner has raised in the present writ petition, in stead of admitting the writ petition and calling for the reply of the respondents, this Court is of the opinion that ends of justice would meet if the writ petition is disposed of directing the respondents 3 to 5 to immediately scrutinize the claim of the petitioner so far as the entitlement for annual increment from the date of passing of Hindi Typing Examination is concerned.

4. Let a decision in this regard be taken by the respondents at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.

5. The writ petition stands disposed of.
