The petitioner has come in the second round of litigation seeking a direction to allow him to join as District Mission Coordinator, Rajeev Gandhi Shiksha Mission, Kabirdham pursuant to order dated 26.12.2015 (Annexure P-1).

Learned counsel for the petitioner submits that by the order dated 26.12.2015, the petitioner was transferred as aforesaid, but has not been allowed to join because some other officer was occupying the office of District Mission Coordinator, Rajeev Gandhi Shiksha Mission, Kabirdham. In the earlier round of litigation this Court has directed to take decision on petitioner's representation vide order dated 14.01.2016, thereafter, till date no order has been passed. However, on 30.07.2016, the incumbent in the office of District Mission Coordinator, Rajeev Gandhi Shiksha Mission, Kabirdham

has now been transferred to some other station and the vacancy has now arisen, therefore, the respondents should allow to join the petitioner on the post of District Mission Coordinator, Rajeev Gandhi Shiksha Mission, Kabirdham.

This Court has directed to decide the petitioner's representation, but no order has been passed. Now, it appears that later on incumbent - respondent No.4, who was working as District Mission Coordinator, Rajeev Gandhi Shiksha Mission, Kabirdham, has now been transferred, therefore, now there should no be any impediment. The petitioner shall be allowed to join. 4.

The petition is accordingly disposed off.
