1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.181/2021 registered in Police Station: Mandir Hasoud, District Raipur for offence under Section 363 and 366 of the IPC.

2. Although the prosecutrix is less than 18 years of age, however, reading of her diary statement and statement under Section 164 CrPC would reveal that she was having an affair with the applicant for the last about 3 years. As per her version of the incident, her parents wanted to marry her with some other boy, therefore, they decided to elope on 25.5.2021. The applicant abducted her and kept her in his own house wherefrom

MCRC No. 4222 of 2021 she was recovered on 27.5.2021. She does not complain of any sexual assault on her person.

3. Considering that the applicant is in jail since 27.5.2021 and the charge sheet has already been filed, I am inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
