1. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.33/2021 registered in Police Station Janakpur, District Koriya C.G. for the offence punishable under Section 307 of the I.P.C.

2. On a dispute concerning grazing of crops belonging to the complainant by cattle belonging to the present applicant, he entered into the house of injured Shivcharan Baiga at about 9:00 pm on 26.3.2021 and inflicted injuries over his left thigh

MCRC No. 4116 of 2021 and over fossa region of abdomen.

3. This applicant is in jail since 28.3.2021 i.e., for more than four months and the charge-sheet has already been filed. Thus, considering all relevant aspects of the matter including the nature of dispute which was the reason for commission of crime, I am inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
