1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.15/2021, registered at Police Station - Keshkal, DistrictKondagaon (C.G.) for the offence punishable under Section 342, 376 (D), 384 of the Indian Penal Code.

3. The prosecutrix and his boyfriend had gone to the house of one Nitesh Swami, where they indulged in sexual intercourse. This act was videographed by accused Dipesh and thereafter all the accused persons demanded sexual favour by blackmailing that if she does not accede to the request, the video would be circulated. On this threat, they sexually exploited the prosecutrix, one after another.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the nature of allegation, I am not inclined to release the applicant on bail reserving liberty in favour of the applicant to revive the prayer after examination of the prosecutrix.

6. Accordingly, the bail application is dismissed with the liberty aforesaid.
