1. There is an application for withdrawal of the appeal on the statement that the parties have entered into a settlement to apply for grant of divorce by mutual consent and for that purpose, an application has also been moved before the jurisdictional Family Court.

2. The statement of fact so made on the basis of which, prayer has been made, is not disputed by any of the parties.

3. Smt. Rajlaxmi, respondent-wife is also appearing in person through Help Desk of the High Court and states that the parties have decided to obtain divorce by mutual consent and for that purpose, they may be permitted to take recourse to the remedy as available to them under the law before the jurisdictional Family Court.

4. Taking into consideration the submissions of learned counsel for the parties, this appeal is dismissed as withdrawn with the liberty as prayed for by learned counsel for the parties to pursue the prayer made before the jurisdiction Family Court for grant of divorce by mutual consent.
