15/05/2018 The case is listed for modification in the order dated 28.02.2018 passed in Cr.A. No. 392/2012.

Counsel for the petitioner submits that in the order dated 28.02.2018 passed in Cr.A. No. 392/2012 there appears to be typographical mistake in the first paragraph of the judgment. From perusal of the record it appears that due to inadvertence the first paragraph has been typed wrongly. The error is apparent on the face of the record and needs to be rectified.

Accordingly, the first paragraph of the judgment dated 28.02.2018 is hereby modified to be read as under:

"This appeal has been preferred against the judgment and order dated 05.09.2011 passed by the Sessions Judge, Mahasamund in Sessions Trial No. 77/2010 convicting the accused/appellant for the offence punishable under Sections 302 and 201 IPC and sentencing him to undergo imprisonment for life with fine of Rs 1,000/- u/s. 302 and to undergo RI for five years with fine of Rs. 500/- u/s. 201 respectively with default stipulations."

Rest of the order dated 28.02.2018 shall remain as it is. With the modification as aforesaid, office reference stands disposed of.

Copy of this order be supplied along with the certified copy of the judgment dated 28.02.2018.
