1. The matter is heard through Video Conferencing.

2. Earlier the appellant had filed Criminal Appeal No.826 of 2020 which was dismissed on merits vide order dated 28.01.2021.

3. This appeal by the accused/appellant under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act is directed against the order dated 30.04.2021 passed by the Special Judge, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Jashpur, District Jashpur, C.G. in connection with Crime No.146/2019, rejecting his regular bail under Section 439 Cr.P.C. for the offence punishable under Section 450, 376(D), 392, 34 of Indian Penal Code and Section

3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, registered at police station Bagicha, District Jashpur, C.G.

4. Learned counsel for the appellant submits that he does not want to prosecute this appeal and seeks to withdraw the same with liberty to file afresh as and when occasion arises.

5. Accordingly, the appeal stands dismissed as withdrawn with the aforesaid liberty.
