Shri Sangharsh Pandey, Dy. GA for the State Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 16/07/2015

1. Petitioner has assailed the legality and validity of the order passed by the Collector, Balrampur, in exercise of appellate powers under Section 91 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (for short 'the Adhiniyam, 1993'). The matter pertains to petitioner's removal from the post of Anganbadi worker.

2. Admittedly, an appellate order passed under the provisions of the Adhiniyam, 1993 is revisable by preferring a revision under Rule 5 of the Chhattisgarh Panchayats (Appeal and Revision) Rules, 1995.

3. In view of the availability of alternative remedy, this Court is not inclined to entertain this writ petition. Accordingly, the writ petition is dismissed. Sd/- Judge Prashant Kumar Mishra ashu
