Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 15-12-2020 in connection with Crime No.182/2020 registered at P.S. - Doundi, District Balod, Chhattisgarh for the offence under Section 363, 366, 368, 376 of the IPC and Section 4, 5, 8 of the POCSO Act.

It is submitted on behalf of the applicant, that the applicant has been falsely implicated in this case. She is in jail since 15-12-2020. No case is made out against this applicant, according to the contents of the FIR and statement of the witnesses. Therefore, it is prayed that this applicant may be granted bail. 3.

Learned counsel for the State/non-applicant opposes the application. 4.

Complainant Kheturam Mankar is virtually present through Help Desk of DLSA Balod. He has no objection in grant of bail to this applicant. 5.

Heard learned counsel for the parties and perused the case diary. 6.

According to the prosecution case, this applicant is real elder sister of the minor prosecutrix. Both of them had been to Balod for making purchase of

-2clothes from where the minor prosecutrix was abducted by main accused Ravi Maravi who was then taken to other place and then he kept her in his custody and also exploited her sexually. After lodging of the FIR, this applicant has been arrested in this case.

Considered on the submissions and looking to the nature of allegation present against this applicant, I feel inclined to allow this application. 8.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for her appearance as and when directed. 9.
