1. This Acquittal appeal arises out of the judgment of acquittal rendered by the Additional Sessions Judge (FTC) in Sessions Trial No.108/2015. Acquittal appeal preferred by the State against the same judgment bearing Acquittal Appeal No.275/2017 has already been admitted for hearing.

2. Office has reported that the present Cr.M.P. is barred by 254 days, however, the applicant being the victim and there being no period of limitation provided under Section 372 of Cr.P.C., as also for the reason that leave to appeal has already been granted to the State and regular acquittal appeal has already been registered, therefore, the present CrMP is allowed.

3. Separate Acquittal Appeal be registered and the same be placed for consideration in the next week along with Acquittal Appeal No.275/2017.
