For the reasons assigned in the application for restoration of the said appeal, I am inclined to allow the same.

Accordingly, the instant M.C.C is allowed and F.A. No. 28 of 2007, is restored to its original number subject to payment of cost of Rs. 1000/- payable to High Court Legal Services Committee within a period of one month from today.
