The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.266/2021, registered at Police Station City Kotwali, Balodabazar-Bhatapara (CG), for the offence under Section 22(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

During search of the present applicant and co-accused Shailendra Dongre & Ganesh Kumar Yadav on 12-5-2021; the co-accused Shailendra Dongre was found in illicit possession of 63 strips total 504 capsule of SPSMO PROXYVON PLUS; and another co-accused Ganesh Kumar Yadav was found in possession of 54 strips total 432 of same capsule whereas the present applicant was found to be illicitly carrying 24 strips total 192 capsule of SPAS TRANCAN PLUS.

Learned counsel for the State, per contra, would oppose the bail application.

Considering the entire facts situation of the case; further considering the fact that the co-accused Shailendra Dongre has already been released on regular bail by this Court vide order dated 7-7-2021 passed in MCrC No.3613 of 2021; as also the fact that the applicant is in jail since 12-5-2021, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
