Hon'ble Shri Justice Sanjay K. Agrawal Order on Board 03/02/2020 1.Learned counsel for the petitioner, after arguing for a fairly long time, submits that since affidavit has not been filed by the petitioner in support of the application under Section 156(3) of the Cr.P.C. and also in view of the fact that the matter is pending consideration before the jurisdictional civil court, petitioner be granted

the liberty to approach the criminal Court after the judgment of civil suit pending between the parties.

2.Prayer, being fair and reasonable, is granted. 3.Accordingly, this petition under Section 482 of the Cr.P.C. stands disposed of with the aforesaid liberty reserved in favour of the petitioner. No cost(s).
