1. Heard finally with the consent of learned counsel for the parties.

2. At the very outset, learned counsel for the parties would submit that the matter in issue is squarely covered by the order passed by this Court in WP(S) No.182/2015 (Satrughan Lal Sinha and others vs. Municipal Council, Bhilai and others and other connected matters) and final order has been passed in the said matter on 06.07.2015, therefore, the present writ petition may also be allowed in terms of Satrughan Lal Sinha (supra).

3. In view of the aforesaid submission made by the learned counsel for the parties, the writ petition is allowed in terms of Satrughan Lal Sinha (supra). Consequently, the impugned recovery is set aside.

4. A copy of the order passed in Satrughan Lal Sinha (supra) be placed in the record of the present writ petition.
