Shri D. Wankhede, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 07/12/2018 The challenge in the present writ petition is to the order Annexure P-1 dated 04.02.2016 whereby the petitioner has been transferred from Balod to Kanker.

Considering the medical ground of the petitioner, this Court had stayed the transfer order on 30.06.2016. Pursuant to the interim order, the petitioner continues to work at Balod. By efflux of time and by virtue of the interim protection, the impugned order dated 04.02.2016 has lost its efficacy.

Accordingly, it is ordered that the respondents shall not act upon the order of transfer so far as the petitioner is concerned any further. However, the right of the respondents is reserved that in the event of any administrative exigency, they are at liberty to pass a fresh order of transfer of the petitioner.
