1. Petitioner is assailing the appointment of respondent No.8 on the post of Panchayat Assistant-cum-Data Entry Operator of Gram Panchayat, Karamtara, block Khairagarh, district Rajnandgaon. The appointment order

issued in favour of respondent No.8 has not been annexed with the writ petition.

2. It is stated that the Gram Panchayat or the Janpad Panchayat is not providing copy of appointment order issued in favour of respondent No.8. Petitioner's application/appeal under Right to Information Act, 2005 is pending.

3. The order under which the respondent No.8 has been appointed was issued by the Gram Panchayat. Under Clause 15 of the guidelines issued by the State Government for appointment of Panchayat Assistant-cum-Data Entry Operator an internal remedy of preferring an appeal under the provisions of Chhattisgarh Panchayat Raj Adhiniyam, 1993 has been provided.

4. In view of the availability of the alternative remedy, this Court is not inclined to entertain this writ petition.

5. Accordingly, the writ petition is dismissed as not maintainable, however, liberty is reserved in favour of the petitioner to prefer the appeal before the appellate authority within a period of thirty days from today. Sd/- Judge Prashant Kumar Mishra ashu
