Hon'ble Shri Justice P. Sam Koshy Order on Board 13/05/2019 1.

The present Review Petition has been filed seeking review of the Order dated 04.04.2019 passed in WPS No. 2467 of 2019. 2.

The counsel for the petitioner at the outset submits that because of certain incorrect facts that were submitted before the court, the order

-2has been passed which is just opposite to the main relief that was sought in the original Writ Petition passed in WPS No. 2467 of 2019. 3.

The counsel for the petitioner further submits that there were a couple of similarly placed writ petitions which have been disposed off by this Court in the past and the petitioner also was seeking an identical order as facts were similar, but inadvertently, the order dated 04.04.2019 does not consist those facts in the orders that have been passed in the similar writ petitions and prayed for the review of the order dated 04.04.2019 with a prayer that the writ petition may be heard on merits and a fresh order be passed, keeping in view, the identical writ petitions which have been disposed off by this Court.

4.

The said fact is not opposed by the State Counsel, so far as the relief sought for in the original writ petition is concerned. The fact that the other similarly placed writ petitions have been disposed off, this Court is of the opinion, that a strong case has been made for review of the Order dated 04.04.2019. Accordingly, the Order dated 04.04.2019 passed in WPS No. 2467 of 2019 stands recalled. 5.

Let the Writ Petition No. 2467 of 2019 be listed for hearing at motion stage on 16.05.2019.

6.

Accordingly, the Review Petition stands allowed and disposed off. Sd/- (P. Sam Koshy) Judge Rahul
