2. Since appellant's application under Section 13 of the Hindu Marriage Act, 1955 was preferred before expiry of one year period from the date of grant of decree for restitution of conjugal rights, the suit was dismissed as the same was preferred before the expiry of the statutory period.

3. In the above circumstances, learned counsel for the appellant prays for and is permitted to withdraw the appeal with liberty to prefer fresh suit for grant of divorce.
