Hon'ble Shri Justice Goutam Bhaduri Order 10/07/2020

1. Learned counsel for the petitioner would submit that the petitioner was suspended on 29.07.2013 and the suspension was revoked on 04.02.2020 and in between the period of 2013-2020 the petitioner has not been paid the entire salary, therefore, he has made a representation dated 28.05.2020 which may be directed to be decided.

-22. In reply, learned State counsel refers to Fundamental Rule 54 (B) (1) and Clause 5 of revocation of suspension order dated 04.02.2020.

3. Considering the limited prayer of the petitioner without any observation on the merits of the case, since the petitioner had already made a representation dated 28.05.2020 (Annexure P-5), he is further given liberty to file a fresh representation to Respondent No. 1 within a period of 3 weeks which shall be decided within a period of 90 days from the date of receipt of a copy of the representation. It is further made clear that this Court has not made any observation about the entitlement of the petitioner.
