(2) The petitioner while working as Senior Dusting Operator in Food Corporation of India at Raipur and has taken voluntary retirement in October, 2004, however his pension has not been fixed nor he has been paid the other retiral dues even after 9 years of his retirement. (3) Learned counsel for the petitioner submits that he is not

pressing this petition at this stage, however, he prays for liberty to file fresh representation for fixing of pension and other retiral dues before the respondent No.3, who in turn, may be directed to process his representation and decide the same within a specified period. (4) Mr. B.P. Gupta, learned counsel appearing for the respondents/Food Corporation of India submits that in case the petitioner files fresh representation, the same shall be decided within four months.

(5) In view of the submission made by learned counsel for the parties, this petition is disposed of with liberty to the petitioner to move a representation before the respondent No.3 for redressal of his grievances, and the respondent No.3 is further directed to consider and decide the same within a period of 4 months from the date of receipt of representation.
