The memo of application under Order 44 Rule (1) CPC filed earlier being defective the applicant was allowed to move fresh application presenting the same in person before the Additional Registrar (Judicial).

The application has now been preferred as required under the CPC. Report of the Tahsildar about the financial status of the appellant is already on record.

On due consideration the appellant is permitted to sue as an indigent person. He was otherwise exempted from payment of Court fees by the trial Court by virtue of notification issued by the State Government under Section 35 of the Courts Fees Act. Let regular First Appeal be registered and the same be placed for hearing on admission on 29.11.2018 on the said date the parties shall be ready to address the Court on merit.
