1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.49/2021 registered in Police Station: Khairagarh, District Rajnandgaon for offence under Section 379/34 of the IPC.

2. The applicants have committed theft of Rs.34,860/- and one mobile set valued at Rs.5,000/- from the complainant on 29.1.2021.

3. Learned State Counsel would oppose the prayer for grant of bail. However, he would submit that the concerned SHO has not reported any previous antecedents of the applicants.

4. Considering that the applicants are in jail since 2.6.2021 i.e. for the last about 2 months, offence is triable by the Judicial Magistrate 1st Class, and there is no previous criminal antecedent of the applicants, I am inclined to release them on bail.

5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
