2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.52/2021 registered at Police Station City Kotwali, Raigarh, District Raigarh (CG) for the offence punishable under Sections 294, 506, 323, 307 of the IPC.

3. The applicant has allegedly has caused one stab wound by means of knife over the person of injured Anish Yadav in a fight

MCRC No. 4223 of 2021 which broke out at 10:00 p.m. on 7.1.2021. The written report was lodged by Mayank Yadav, brother of injured Anish Yadav on 13.1.2021 mentioning that the injured has been discharged from the hospital. However, the documents relating to the treatment provided to the injured, mentions the date of discharge as 22.1.2021. Moreover, the MLC has been issued on 11.3.2021 showing only one stab wound.

4. The applicant is in jail since 12.3.2021 i.e. for about 5 months and the charge sheet has already been filed, therefore, considering all the relevant aspects of the matter, I am inclined to release the applicant on regular bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
