The trial Court has acquitted the accused of the charges under Section 436 of the IPC.

Considering the eye-witness account rendered by PW-1 Mamta Sidar and PW-2 Akti Bai , who had seen the accused running away from the place of occurrence after setting ablaze the house of PW-2 Akti Bai, the present appears to be a fit case for grant of leave to appeal. 4.

Accordingly, the CRMP is allowed.

Let regular acquittal appeal be registered and the same be placed for consideration in the next week.
