1. Learned counsel for the appellant would submit that after old Act of MP Accommodation Control Act 1961, new Act i.e., Chhattisgarh Rent Control Act, 2011 has come into force, therefore, by efflux of time the instant appeal has become infructuous, as such he seeks permission of this court to withdraw this appeal with liberty to file afresh under Chhattisgarh Rent Control Act, 2011, if exigency so arises in future.

2. Prayer is allowed.

3. Accordingly, the instant appeal is dismissed as having become infructuous with the aforesaid liberty.
