(1) According to the learned counsel appearing for the State, order passed by the Director General of Police rejecting appeal of the petitioner, second appeal would lie to the State Government by virtue of provisions contained in Section 262 of the Chhattistarh Police
Regulations.
(2) In view of the statement made by learned counsel appearing for the State, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to file appeal to the State Government and the same may be directed to be decided by the authority concerned within the specific time frame. (3) Prayer appears to be fair & reasonable.
(4) Accordingly, it is directed that if petitioner prefers appeal before the State Government within a period 30 days from today and in turn the State Government shall decide the appeal of the petitioner in accordance with law expeditiously preferably within a period of four months from the date of receipt of presentation. (5) With the aforesaid observations, the writ petition stands finally disposed of.
