1. The limited relief that the petitioner seeks in the present writ petition is for an appropriate direction to the respondents to consider the representation/objections that petitioner has preferred against the order of penalty dated 13.10.2020, and order of recovery for an amount of Rs. 1,66,543/-.

2. Mr. Himanshu Pandey appearing for the respondents submits that since the order dated 13.10.2020 being an appealable order and the representation being pending before the respondent authorities the same be if is treated as an appeal then the same shall be decided in accordance with the rules and regulations governing the field.

Without expressing any opinion on the merits of the case, so far as the veracity of the impugned order is concerned, the writ petition at this juncture stands disposed of directing the respondents to treat the representation which the petitioner has made as an appeal and decide the same as if the appeal is being decided at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.
