Learned counsel for the petitioner would submit that petitioner is suffering from order of his suspension since 09/01/2001 and no final decision has been taken in this regard by the Sub-Divisional Officer (Revenue), Khairagarh, therefore, the petitioner be allowed to make representation before the SubDivisional Officer (Revenue), Khairagarh along with judgment
rendered by the Supreme Court in the matter of Ajay Kumar Choudhary v. Union of India through its Secretary and another1.

Be that as it may, the petitioner is directed to file representation before the Sub-Divisional Officer (Revenue), Khairagarh along with judgment rendered by the Supreme Court in the matter of Ajay Kumar Choudhary (supra) within a period of 10 days, who in turn shall consider and decide the same in accordance with law within a period of one month from the date of filing of the representation.

With the aforesaid direction, writ petition stands finally disposed off. It is made clear that this Court has not expressed any opinion on the merit of the case.
