The grievance of the petitioner in the instant Writ Petition is that, the petitioner had participated in the departmental promotion process for filling up the post of 'Deputy Manager, Technical' and the petitioner on participation was found meritorious.

However, the petitioner's case could not be considered in the light of the subsequent departmental enquiry which was initiated. 3.

Lateron, the departmental enquiry culminated exonerating the petitioner of all the charges.

The counsel for the petitioner submits that, pursuant to the exoneration of the petitioner in the departmental proceedings, the petitioner was liable to

be issued with an order of promotion to the post of 'Deputy Manager, Technical'.

However, the respondents till date have not taken any decision on the said claim of the petitioner. Neither have the respondents till date rejected the candidature of the petitioner, nor has the petitioner be intimated in respect of his claim.

In the given facts, this Court is of the opinion that no fruitful purpose would be served in keeping the writ petition pending, rather ends of justice would meet if the writ petition is disposed off with a direction to the respondent No.1 to look into the grievance raised by the petitioner and pass a suitable order so far as the claim of the petitioner for the promotional post of 'Deputy Manager, Technical' for which he had already participated in the promotion process and was also found meritorious. 7.

Let the respondent No.1 take a decision in respect of the claim of the petitioner within a period of 60 days from today. 8.

It is made clear that, this Court has not expressed any opinion so far as the claim of the petitioner is concerned.

The respondents would be at liberty to decide the same in accordance with the rules governing the service condition.
