By the order impugned, the respondent No.2-Executive Engineer, Public Health Engineering Department, Division Korba has directed the petitioner for eviction of Govt. Quarter No.G/2 in question. 2.

Learned counsel appearing for the petitioner would submit that the petitioner is going to retire within six months and notice has been issued by the respondent No.2 for eviction of the said Govt. quarter in which he has been living with his family since 11.05.2009 and therefore,

the petitioner may be permitted to make representation before the respondent No.4-Collector, Korba.

Be that as it may, the petitioner may make a representation before the respondent No.4 within ten days and in turn, the respondent No.4 is directed to consider and pass a fresh order on the representation of the petitioner within a period of one month from the date of receipt of representation of the petitioner on its own merit and in accordance with law.

Since the petitioner is residing in the allotted premises, till the decision of representation of the petitioner, he will not be evicted from the allotted premises for a period of four weeks. 5.

Accordingly, the writ petition stands finally disposed off. No order as to cost(s).
