Hon'ble Shri Justice Pritinker Diwaker Order On Board 17/01/2017 (1) Counsel for the petitioner submits that as in the year 2012 all the respondents have been transferred and have been given new assignment, the petitioner may be permitted to withdraw this petition with liberty to file a fresh representation before the Department of Technical Education and Director of National Institute of Technology. He, however, submits that a direction may be issued to these authorities to decide the said representation to be filed by the petitioner in accordance with law within some time frame.

(2) Accordingly, the petition is dismissed as withdrawn with liberty as aforesaid.

(3) Needless to say that if any such representation is made by the petitioner, it would be for the competent authority to act in accordance with law expeditiously.

(4) It is made clear that this Court has observed nothing on merits of the case.
