The applicants have preferred these applications for grant of bail as they are arrested in connection with Crime No.99/2017 registered in Police Station Farasgaon, District Kondagaon (C.G.) for offence punishable under section 20 B (II) (C) of NDPS Act. 2.
As per the prosecution case, on a secret information received that in vehicle bearing No. M.H.32-C/3202 cannabis are being transported vehicle was intercepted and as per prosecution another vehicle fled away from the scene. Subsequently, few of the accused were arrested. Subsequently, Rahul Honade was arrested on the same date on
8/10/2017 and Rajkanya @ Kalo Bai was arrested subsequently on 23/03/2018 after six months.

Learned counsel for the applicants submits that except memorandum there is no evidence against the applicants. It is further submitted that there is no evidence that the applicant Rajkanya @ Kalo Bai was in any way involved in the case. She was arrested after six months of the incident and it is stated that amount of money which was recovered from the possession of Rajkanya @ Kalo Bai was amount obtained by sale of paddy, therefore the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail and would submit that on the date of incident two vehicles were following each other one vehicle was caught and the other fled away. Subsequently, on investigation it was found that in another vehicle the cannabis were being transported and it was being handled by Rajkanya @ Kalobai. 5.
Perused the case diary. It appears that vehicle bearing No. M.H.32C/3202 which was apprehened on the spot being driven by Rahul Honade and 1 quintal 47 kg and 888 gms of cannabis were recovered and subseuently during investigation it revealed that in another vehicle Raj Kanya was also involved in the business of sale of cannabis and when raid was conducted from the house of Rajkanya huge cash was recovered. Taking into case diary and the documents, this court is not inclined to release the applicants on bail.
