Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /08/2021 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.71/2021 registered in Police Station Moudahapara, District Raipur for offence under Section 22 (b) of the NDPS Act.

2. The applicant was found in illicit possession of 680 tablets of Nitrosun 10 involving Nitrazepam Tablets of Sun Pharma Company, each tablet weighing about 10 mg. Thus total quantity of tablets comes to 387.6 grams and hence as per the prosecution case, total 387.6 grams of contraband was recovered from the applicant.

3. The quantity recovered from the applicant is intermediate quantity i.e. more than small quantity but less than commercial quantity.

4. Learned State Counsel would oppose the prayer for grant of bail. He would submit that the concerned SHO has not reported any previous criminal antecedent of the applicant.

5. Considering that the applicant is in jail since 7.6.2021 and charge sheet has already been filed and that the applicant has no previous antecedents, I am inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
