The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.184/2021, registered at Police Station Telibandha, District Raipur (CG), for the offence under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Applicant along with co-accused Nikhil Yadav and Jitendra Das were found in illicit possession of 21.100 kgs. of ganja when

MCRC No.4518 of 2021 they were traveling together in I20 car bearing registration No.CG-04-LF-6953 on 30-5-2021.

Learned counsel for the State, per contra, would oppose the bail application. However, he would submit that the concerned Station House Officer (SHO) has not reported any previous criminal antecedents of the applicant.

Considering the entire facts situation of the case, as also for the fact that the applicant is in jail since 30-5-2021, and the quantity of contraband if split amongst three accused who were found in joint possession, it would be less than the commercial quantity, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
