Shri Goutam Burad (husband) and Smt. Leena Burad (wife) are present.

FAM No.61/2011 is an appeal preferred by the husband challenging rejection of his application under Section 9 of the Hindu Marriage Act, 1955 (henceforth 'the Act, 1955') for restitution of conjugal rights, whereas FAM No.2/2015 is an appeal preferred by the wife challenging dismissal of her application under Section 13 of the Act, 1955 for grant of divorce. 3.

On 26.07.2017, Shri Patankar, learned counsel for the wife had informed this Court that both the parties are presently living together happily, therefore, both of them would like to remain present before this Court at the time of disposal of the present appeals.

Both the parties would state that for the past about 2 years, they have amicably settled their dispute and are residing together peacefully and happily. They would also state that their son, aged about 12 years, is studying in a local school. 5.
