MCRC No.4366 of 2021 & MCRC No.4419 of 2021 23/8/2021 1.

Since both the bail applications are arising out of crime No.104/2021 they are being considered and decided by this common order 2.

The applicants have preferred these bail applications under Section 439 of the Cr.P.C. for grant of bail as they have been arrested in connection with Crime No.104/2021, registered at Police Station Kharsiya, District Raigarh (CG), for the offence punishable under Sections 364-A, 368, 120-B & 201/34 of the Indian Penal Code and under Section 25 of the Arms Act.

The accused persons have kidnapped the victim, aged about 6 years, for demanding ransom, but before the demand could be raised the concerned police arrested the accused persons in the State of Jharkhand. There are allegation of concealing/ interpolation with the registration number of motorcycle in which the kidnapping was made.

Learned counsel for the State, per contra, would oppose the bail applications.

Considering the nature of allegations, I am of the opinion that present is not a fit case to release the applicants on regular bail at this stage.

Accordingly, both the bail applications are rejected with liberty to revive the prayer for grant of bail after examination of the material witnesses including the victim and his father. Sd/- (Prashant Kumar Mishra) Acting Chief Justice Gowri
