1. The applicants have preferred this bail application under Section 439 of the Cr.P.C. for grant of regular bail as they are arrested in connection with crime No.48/2021 registered in Police Station Dhamdha, District Durg C.G. for the offence punishable under Sections 304-B, 498-A, 34 of the I.P.C.
2. Deceased Kavita Verma was married with Haresh Verma in March, 2017. She committed suicide by hanging in her matrimonial house on 24.2.2021. After merg enquiry, FIR
MCRC No. 4411 of 2021 was registered after two months in which there is allegation that the applicants who are father-in-law and mother-in-law respectively were committing mental and physical cruelty on the deceased by asking her to arrange funds from her parental house for treatment of her husband Haresh Verma.
3. It is debatable whether the allegation of arranging funds for treatment of her husband would amount to dowry. Prima facie, such demand is not made in connection with marriage.
4. Considering all relevant aspects of the matter as also for the fact that present two applicants who are father-in-law and mother-in-law are in jail since 09.3.2021; charge-sheet has already been filed, I am inclined to release the applicants on bail.
5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
