This is second bail application under Section 439 of Cr.P.C. The earlier bail application was dismissed on 10/03/2017 vide M.Cr.C. No.879 of 2017.

The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.381/2016 registered in Police Station Kasdol, Distt. Baloda Bazar-Bhatapara (C.G.) for offence punishable under sections 454, 394, 414, 120B of IPC, Sections 25 & 27 of the Arms Act and Section 65(B) of the I.T. Act. 3.

As per the prosecution case, the applicant alongwith four other accused has committed robbery of the complainant Pramod Kumar Sahu on 8/10/2016. Thereby offence has been committed. 4.

Learned counsel for the applicant submits that other co-accused has been enlarged on bail on the ground of delay and the case of the applicant may be considered on the ground of parity. 5.

Learned State counsel is not able to dispute the fact that other co-

accused has been enlarged on bail on the ground of delay. 6.

Considering the fact that other co-accused has been enlarged on bail on 13/03/2018 vide M.Cr.C. No.133 of 2018 on the ground of delay, therefore this court is also inclined to release the applicant on bail. 7.

Accordingly, the second bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
