Hon'ble Shri Justice P. Sam Koshy Order On Board 24.06.2021

1. The petitioner seems to be aggrieved by the order passed by the Respondent No. 2 dated 05.06.2021, whereby the petitioner has been transferred from the office of the District Panchayat Raipur holding the additional charges of Khadi production Centre, Saragaon to the Khadi production Centre, Saragaon.

2. Counsel for the petitioner drew the attention of this Court to certain posting orders that were issued in the recent past, wherein the petitioner has been shifted very frequently from one office to another office. Now vide the impugned order yet again he has been shifted from one office to another office. It is true that there appears to have been certain frequent shifting of the petitioner from one office to another but this time taking into consideration the distance between the two place

from where the petitioner is being shifted this Court does not find a strong case for interference with the impugned order in exercise of its extraordinary powers under Article 226 of the constitution of India in the course of exercising the powers of judicial review on an order of posting, attachment or transfer. The only relief that the petitioner can be given is to make a suitable representation to the respondent No. 2 considering the grievances that the petitioner has, particularly inrespect-of the frequent changes in place of posting that has been given to the petitioner and the respondent No. 2 in turn shall consider the said representation on its own merits after due verification of the facts on the administrative side at the earliest preferably within a period of 45 days from the date the petitioner makes a representation in this regard.

3. The writ petition accordingly stands disposed of. Sd/-
