• State Of Chhattisgarh Through PS Sargaon, District Mungeli (CG) ---- Non-Applicant For Applicant : Shri B.L. Dembra, Advocate. For Non-Applicant : Smt. Fouzia Mirza, Additional AG. Proceeding Through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 31/08/2020 :

1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.96/2020 registered in Police Station Sargaon, District Mungeli for offence under Section 457 and 380 of the IPC.

2. The present applicants along with third accused Sandeep committed theft of cash of Rs.9,000/-, silver ornaments and mobile phone, total amounting to Rs.22,000/- from the house of complainant during the intervening night of 28/29th April, 2020.

3. Learned State Counsel would oppose the prayer for grant of bail on submission that the applicants are habitual offenders.

4. Considering that the offence is triable by the Judicial Magistrate 1st

Class, the applicants are in jail since 14.5.2020 and charge sheet has already been filed, this Court is inclined to release the applicants on bail with the following conditions:- • they shall appear before the concerned Police Station on First and Fifteenth day of every month during the pendency of trial; • they shall not get involved in any criminal offence during the pendency of trial;

• registration of any criminal case against them would entail automatic withdrawal/cancellation of this bail order and the concerned Police shall be entitled to arrest them immediately on registration of fresh criminal case against them after informing the trial Magistrate; • each of the applicant shall execute a personal bond for a sum of Rs. 50,000/- with one surety for the like amount to the satisfaction of the trial Court and • they shall appear before the trial Court on each and every date given by the said Court.
