Aggrieved by the action on the part of the respondent No.1 in taking cognizance to a complaint lodged by the respondent No.2, the present writ petition has been filed. The petitioner assails the taking of cognizance by the respondent No.1 on the ground of jurisdiction keeping in view the contents of the complaint. 2.

During the course of the hearing it has been revealed that the petitioner on receipt of a summons has already entered appearance before the commission and has also filed his objection in respect of the maintainability of the complaint before the respondent No.1-

commission and also questioning the jurisdiction and authority of the respondent No.1-commission. The said objection of the petitioner is yet to be decided by the respondent No.1. 3.

Since the petitioner has already entered before the respondent No.1 and has lodged an objection, it would be premature for this High Court to exercise of its power of judicial review at this stage to the action initiated by the respondents. expecting an early decision on the objection that the petitioner has raised before the commission, if at all if the same is not yet decided, the writ petition at this juncture stands disposed of.

In case if the petitioner has not raised his objection till now, the petitioner would be at liberty to raise such objection on the next date of hearing, as and when the case is listed before the commission, which the commission shall decide on its own merits in accordance with law.

With the aforesaid observations, the present writ petition stands disposed off.
