1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.1070/2019 registered in Police Station Durg, District Durg for offence under Section 457 and 380 of the IPC.
2. The present applicant and co-accused have committed theft of cash amount of Rs.11,000/- and gold and silver ornaments valued at Rs.25,000/-.
3. Learned State Counsel would oppose the prayer for grant of bail.
4. Considering that co-accused has been granted bail in MCRC No.3204/2020 (Naeem Baksh Vs. State of Chhattisgarh) vide order dated 16.7.2020 and the offence is triable by the Judicial Magistrate 1st Class, this Court is inclined to release the applicant on bail with the following conditions:-
• he shall appear before the concerned Police Station on First and Fifteenth day of every month during the pendency of trial; • he shall not get involved in any criminal offence during the pendency of trial;
• registration of any criminal case against him would entail automatic withdrawal/cancellation of this bail order and the concerned Police shall be entitled to arrest him immediately on registration of fresh criminal case against him after informing the trial Magistrate; • the applicant shall execute a personal bond for a sum of Rs. 50,000/- with one surety for the like amount to the satisfaction of the trial Court and • he shall appear before the trial Court on each and every date given by the said Court.
