1. Heard.

2. At the very outset, as prayed by learned counsel for the applicant, he is permitted to correct the description of Police Station in the memo of bail application. Let it be done during the course of the day.

3. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.11/2021, registered at Police Station - Bhanpuri, District - Bastar (C.G.) for the offence punishable under Section 307 of the Indian Penal Code, 1860.

4. On account of dispute concerning sapping (tadi) from the Palm tree, which the injured claimed to be grown by her father-in-law and not by this applicant. She was assaulted thrice over head, cheek and mandible region by means of axe.

5. The injured was admitted in the hospital from 13-01-2021 to 23-1-2021. As would be clear from the material available in the case diary, the parties are relatives residing in the remote tribal area of Bastar district.

6. Learned State counsel would oppose the prayer for grant of bail.

7. The applicant is in jail since 13-01-2021 i.e. for more than seven months; charge sheet has already been filed and considering all the relevant aspects of the matter, I am inclined to release the applicant on bail.

8. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
