Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /08/2021 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.123/2021 registered in Police Station Kawardha, District Kabirdham for offence under Section 376 (2)(N) and 493 of the IPC.

2. The prosecutrix aged about 19 years has lodged a written complaint alleging that the applicant has committed forcible sexual intercourse on promise to marry from the year 2017 to 2021. However, despite repeated requests, he is avoiding to marry her.

3. Considering that the prosecutrix is more than 18 years of age, delay in

MCRC No. 4611 of 2021 lodging the FIR and for the fact that the applicant is in jail since 17.2.2021 & charge sheet has already been filed, I am inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
