Hon'ble Shri Justice P. Sam Koshy Order on Board 16.05.2019

1. The grievance of the petitioner is in respect of withdrawal made from the GPF account of the petitioner way back in the year, 1997.

2. This court, prima facie, is of the opinion that this petition suffers from delay and laches. The alleged withdrawal has been made in the year, 1997. The petitioner was in service even after that for a period around six years, during which time the petitioner did not care to raise an objection in this regard. The petitioner stood retired from service w.e.f. 2004. The present writ petition has been filed after more than 15 years from the date of retirement. No plausible explanation has been given for filing of this petition after 15 years from the date of retirement.

3. Accordingly, the writ petition stands dismissed on the ground of delay and laches.

4. Needless to mention that though this court has not entertained the writ petition, but that would not preclude the petitioner from approaching the authorities in the department or any other forum available to the petitioner so far as the complaint of illegal withdrawal from the GPF account is concerned.
